Position Title: Manager, Marketing Compliance (Paralegal)

Location: New York, NY (Headquarters)

Position Summary:

The Marketing Compliance Manager will:

  • Review advertising and marketing programming and labeling (e.g., social media brand pages and social posts, label review for product claims and Intellectual Property, ad copy, product formulas, and coupons/rebates, sweepstakes, and other promotions) to ensure compliance with all federal and state trade practice, marketing and intellectual property laws, and other regulations applicable to the marketing of alcohol beverage products in the US.
  • Review, draft, and negotiate simple marketing agreements, including co-promotion, sponsorship, confidentiality, influencer, agency, and other agreements.

  • Major Responsibilities / Accountabilities:

  • Review of marketing materials, product labeling and claims, e-commerce, sweepstakes and other promotions, and brand advertising campaigns to ensure compliance with federal and state alcohol beverage laws, TTB, intellectual property laws, intellectual property, marketing and advertising laws, and DISCUS and Company guidelines. Conduct and provide legal advice regarding trademark searches.
  • Draft and negotiate terms for confidentiality, co-promotion, sponsorship, event, Statements of Work and other simple marketing agreements.
  • Give legal training to clients and assist with on-boarding legal department personnel, including administrators and interns. Assist with the other managerial aspects of the marketing compliance function, seeking advice from attorneys where appropriate.

  • Nature & Scope:

    This employee will be handling sensitive information regarding our products and marketing programs, both internally and externally. Positive interaction and support of members of the Marketing Department is necessary to achieve business commitments and maintain brand strategy. Must be able to conduct efficient legal review and decision making while consulting with senior counsel for more complex marketing compliance issues, if appropriate. The employee will also be working with attorneys and state regulatory personnel.

    Education: College Degree (4 year)

    Experience / Background: At least 2+ years experience working in marketing or advertising compliance in a corporate setting or law firm required. Familiarity in advertising, intellectual property and/or state alcohol beverage laws advantageous.

    Working Conditions:

    General Office: Work is performed in a typical office environment. Limited demands for movement and lifting. Normal visual, hearing and language acuity required for correspondence and computer usage.

    Travel: Occasional

    Estimate: 5% of time
